Hemp. Marijuana. Medical cannabis. Adult-use cannabis.
The words are often used interchangeably in everyday conversation, but in Virginia, they don't necessarily mean the same thing.
They can describe products that come from closely related plants while being governed by very different rules about how they're produced, sold, purchased, and used.
And Virginia's cannabis laws are changing again.
So let's make it simpler.
First, Why Is This So Confusing?
Part of the confusion comes from the plant itself.
Hemp and marijuana are both forms of cannabis. But the law creates different categories and then establishes different rules for each one.
That means two products may look similar to a customer while being treated very differently legally.
The easiest way to understand Virginia today is to think about three separate pathways: regulated hemp, medical cannabis, and adult-use marijuana.
What Is Hemp in Virginia?
Virginia law establishes specific requirements for products that can be sold as hemp products.
As of August 15, 2026, hemp products offered for retail sale in Virginia cannot exceed 0.3% total THC or more than two milligrams of total THC per package. Virginia also eliminated the previous provision that allowed certain higher-THC products when they contained at least 25 times as much CBD as THC.
Products that fall within Virginia's hemp requirements can be sold through regulated hemp product retail facilities. The CCA currently lists hemp products sold by regulated hemp retailers among the forms of cannabis access permitted in Virginia.
Depending on the product, hemp may appear in forms such as flower, extracts, topicals, foods, beverages, or other finished products.
But the word “hemp” alone doesn't tell you whether a particular product can legally be sold in Virginia.
The actual formulation, THC content, packaging, labeling, testing, and other applicable requirements matter.
What Is Marijuana?
Virginia law treats marijuana separately from regulated hemp.
For consumers, one of the most important distinctions today is that legal possession and legal retail sales are not the same thing.
Virginia currently permits adults to possess cannabis within specified limits, cultivate a limited number of plants at home, and privately share certain amounts between adults 21 and older without payment. But non-medical retail sales of marijuana are currently illegal.
That means seeing cannabis described as legal in Virginia doesn't automatically mean you can legally walk into a store and purchase adult-use marijuana today.
Possession may be legal while the retail transaction is not.
That's one of the most important distinctions for Virginia consumers to understand.
What Is Medical Cannabis?
Virginia already has a regulated medical cannabis program.
Eligible patients can receive a written certification from an authorized practitioner and then access medical cannabis through licensed dispensaries. Patients must meet the program's requirements and present the appropriate certification and identification when accessing products.
Unlike the future adult-use market, medical cannabis isn't simply a 21+ retail category.
Virginia's program permits eligible adults to participate and provides a pathway for minors or vulnerable adults through parents, legal guardians, and other authorized participants under specified circumstances.
So when you see a medical cannabis dispensary operating in Virginia today, it is participating in a different regulatory system from a regulated hemp retailer.
Can You Buy Recreational Marijuana in Virginia Today?
Not yet.
As of October 2026, Virginia does not permit non-medical retail sales of marijuana. The CCA states that regulated retail marijuana sales are scheduled to begin July 1, 2027.
That future market is sometimes described as recreational cannabis, adult-use cannabis, or retail marijuana.
Whatever terminology you encounter, the important distinction is that the market is still being developed.
The CCA is currently developing the regulatory framework and licensing processes for businesses that want to participate.
So What Can Virginia Consumers Legally Purchase Today?
As of October 2026, the simplest way to think about legal retail access is this:
|
Category |
Can Virginia consumers legally purchase it today? |
How? |
|---|---|---|
|
Regulated hemp products |
Yes |
Through businesses permitted to sell compliant hemp products |
|
Medical cannabis |
Yes, for eligible patients |
Through Virginia's medical cannabis program and licensed dispensaries |
|
Adult-use marijuana |
Not through retail stores yet |
Regulated retail sales are scheduled to begin July 1, 2027 |
Virginia's CCA currently identifies compliant hemp retail and licensed medical cannabis as legal while stating that buying or selling adult-use cannabis remains illegal until the regulated market opens.
Why Can Products That Look Similar Be Treated Differently?
Because appearance isn't what determines the legal category.
A flower, edible, beverage, or extract might look similar to another product while being subject to a different regulatory framework.
The product's composition, THC concentration and amount, intended use, source, testing, labeling, and the system through which it is sold can all matter.
That's why making purchasing decisions based only on words like hemp, CBD, THC, cannabis, or marijuana can be misleading.
The label on the front tells part of the story. The product information and regulatory category tell the rest.
Virginia's Cannabis Market Is Still Evolving
Virginia is currently in an unusual transition period.
The CCA assumed responsibility for regulated hemp-product oversight in 2026, new hemp requirements took effect August 15, and the Commonwealth is now building the regulatory framework for adult-use marijuana sales scheduled to begin July 1, 2027.
That means some of the rules consumers and businesses have grown accustomed to are changing.
It's also why information that was accurate a year ago may no longer be accurate today.
Where Does Natural Aid Fit In?
Today, Natural Aid operates within the rules governing the products we're currently permitted to offer.
As those rules change, our product selection and operations change with them.
We're also following the development of Virginia's regulated adult-use cannabis market and plan to pursue opportunities to participate through the appropriate licensing process as that market takes shape.
Until then, we think our responsibility is straightforward: be clear about what we can offer today, follow the rules that apply today, and don't represent tomorrow's opportunities as today's reality.
That's what responsible participation in a changing industry looks like to us.
Different Categories. Different Rules. Better Questions.
You don't need to become an expert in Virginia cannabis law to make an informed purchase.
But understanding the basic categories helps.
Hemp isn't automatically the same thing as marijuana. Medical cannabis operates through its own program. Legal possession doesn't necessarily mean legal retail sale. And Virginia's future adult-use market isn't open yet.
When something isn't clear, ask questions.
What kind of product is this? What's in it? How much THC does it contain? Where is it legally sold? Is there testing information available?
Those questions tell you much more than a familiar word on the package ever could.
Cannabis can be complicated. Understanding what you're actually buying shouldn't be.
